1. Introduction

These Terms & Conditions (“Terms”) govern your access to and use of the website stom.co.ke (the “Site”) and any services, products, features, or content offered through the Site. By using the Site you agree to be bound by these Terms. If you do not agree, do not use the Site.

2. Who We Are

3. Accounts

Users may register for an account on the Site. You agree to provide accurate and up-to-date information when creating an account and to keep your account credentials secure.

We monitor and review user accounts manually. We reserve the right, in our sole discretion, to suspend, restrict, or terminate accounts at any time for violations of these Terms or for any conduct we reasonably believe is harmful to the Site, other users, or third parties.

Users may publish content on the Site, including but not limited to comments, images, videos, and other materials (“User Content”). By submitting User Content you grant the Site a non-exclusive, transferable, sublicensable, worldwide, royalty-free license to use, reproduce, modify, publish, distribute, and display such content for commercial, marketing, promotional or any other lawful purposes.

We monitor and review User Content and reserve the right to modify, remove, or refuse any User Content at our discretion, including content that violates these Terms or applicable law. While we take reasonable steps to back up and protect data, you acknowledge that no system is completely secure and that loss or disclosure of data may occur. 5. Products & Services

The Site offers tangible products (shipped items), digital products (downloadable items), and online services (non-downloadable services). We may offer free trials, recurring subscriptions, and auto-renewal of subscription payments where indicated in the product or subscription terms.

We may sell products or services provided by third parties. All third-party products and services are subject to their own terms and conditions; by purchasing such items you may also be agreeing to those third-party terms.

6. Orders, Pricing, & Changes

We reserve the right to change product or service descriptions, availability, and prices at any time. All prices displayed on the Site are subject to change without notice.

We reserve the right to refuse or cancel any order for any reason, including but not limited to suspected fraud, product unavailability, or pricing errors. If we cancel an order that has already been charged, we will refund you pursuant to our refund policy.

7. Payments & Security

Users may pay via remote third-party services (for example, PayPal, Stripe) or directly on the Site. We have security measures in place to protect payment information; however, no transmission over the Internet is completely secure. By using a payment method you authorize us and/or our third-party payment processors to charge the amount due.

Where third-party payment services are used, you also agree to and are subject to the terms, privacy policies, and procedures of those third parties.

8. Free Trials, Subscriptions & Renewal

When you sign up for a free trial or subscription, you agree to the subscription terms and any auto-renewal terms disclosed at the point of purchase. You are responsible for cancelling subscriptions before the renewal date if you do not wish to continue; we may, but are not required to, provide reminders of upcoming renewals.

9. Uptime & Availability

We do not guarantee uninterrupted access or an uptime guarantee for the Site or any services. The Site may be unavailable from time to time for maintenance, upgrades, or other reasons.

10. Affiliate Links & Advertising

The Site may contain affiliate links and display third-party advertisements (for example Google AdSense). We may receive a commission or referral fee for purchases made through affiliate links. Advertisements and affiliate material are the responsibility of the advertisers and affiliate partners.

15. Limitation of Liability

To the fullest extent permitted by applicable law, in no event will the Site, its owners, officers, or agents be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, or for any loss of profits, revenue, data, or business opportunities arising out of or in connection with the use of the Site, even if we have been advised of the possibility of such damages. Our total aggregate liability for direct damages will not exceed the amount you actually paid to us for the product or service giving rise to the claim in the 12 months prior to the claim.

These Terms are governed by the laws of the Republic of Kenya. Any dispute arising out of or relating to these Terms or the Site shall be subject to the exclusive jurisdiction of the courts of Kenya, unless the parties agree otherwise in writing. You and the Site agree to attempt in good faith to resolve disputes informally before initiating formal legal proceedings.

18. Severability

If any provision of these Terms is held to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions will remain in full force and effect to the fullest extent permitted by law.

We may update these Terms at any time. When we do, we will update the modification date at the top of this page and may post a notice on the Site. Your continued use after such updates constitutes acceptance of the updated Terms. It is your responsibility to review the Terms periodically for changes.
